ORDERS:

CONSENT ORDER TO STRIKE RULE 40

As to the within matter, it appears that a case tried in the circuit court for the Ninth Judicial Circuit, to wit: City of Charleston, et al vs. Thomas J. Masi, et al, Case No.: 02-CP-10-4032, and which is under advisement, may be dispositive of the issues raised herein. It is therefore stipulated that the within matter is struck pursuant to SCRCP, Rule 40(j) applicable to these proceedings by virtue of ALJD Rule 68, with the express stipulation and acknowledgment that the it may be restored upon motion within one year of the date this matter is stricken, that the statute of limitations shall be tolled during all such time as the matter remains stricken, and any unexpired portion of the statute of limitations on the date the case is stricken shall remain and begin to run upon the claim being restored.

IT IS SO ORDERED.
