ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter is before me upon the Motion of the Petitioner, by and with the consent
of the Respondent. The parties were scheduled to appear before this court on
June 16, 2005, for a hearing on Petitioner’s Request for a Contested Case
Hearing. Prior to the hearing, the parties reached an agreement to settle the
case.
The
issue in this case is whether Petitioner timely filed a request for
reconsideration of the Medical Board decision denying her application for
disability retirement benefits. Respondent has agreed to accept a new
application for disability retirement benefits, consider Petitioner’s medical
conditions existing as of October 25, 2004, and process the new application
according to its standard procedures. Pursuant to S.C. Code Ann. § 9-1-1540
(1986 & Supp. 2004), if Petitioner is approved for disability retirement
benefits, Petitioner’s date of retirement will be thirty days after the date
the new application is filed with the Respondent.
NOW
THEREFORE, on motion of Elizabeth Dalzell, attorney for Petitioner, and with
the consent of Kelly H. Rainsford, attorney for Respondent,
IT
IS HEREBY ORDERED, ADJUDGED, AND DECREED that the above action is dismissed.
