ORDERS:

CONSENT ORDER OF DISMISSAL

The above-captioned matter was filed with the Administrative Law Court on March 8, 2005. The Petitioner challenged the Respondent’s evaluation of property located at N/S Percival Road, identified as Tax Map Number 25600-03-11, for the 2003 tax year. The parties have agreed that the taxable value of the real property subject to this appeal for the 2003 tax year is $1,550,100.00, and that taxes due thereon are $41,873.10. The Petitioner, having paid $46,523.67 on the original assessment is due a refund from Respondent in the amount of $4,650.57, which Respondent has agreed to make payable to Petitioner as soon as practical following the issuance of this Order.

NOW, THEREFORE, IT IS ORDERED that this case is dismissed without prejudice; provided that upon payment of the refund set forth herein to Petitioner by Respondent, this case shall be dismissed with prejudice without further order of the Court.

AND IT IS SO ORDERED.
