ORDER GRANTING RESPONDENTS MOTION FOR REMAND

This matter is pending before the Administration Law Court. On April 28, 2005, Motion for Remand was filed by the Department based upon the grounds that in the appeal of Eugene Davis, he challenges his conviction of Soliciting Assistance from an Employee or an Inmate to Violate an Agency Rule or an Employee Rule and his subsequent loss of 60 days of good time.

Based upon the foregoing reasons, The Department requests that this case be remanded to the Department so that the Department may overturn Davis’ conviction and restore any lost good time. Therefore,

IT IS HEREBY ORDERED that the Department’s Motion for Remand be granted.

AND IT IS SO ORDERED.
