This matter is pending before the Administrative Law Court. On April 13, 2005, Motion
for Remand was filed by the Department based upon the grounds that in the appeal of Rodney
Jones, he challenges his conviction of Knowingly Making False Statements for the Purpose of
Harming Another on May 17, 2004, and the loss of 30 days good time credits. In preparation
of filing the Record, the Department has determined that Jones’ disciplinary conviction should
be overturned. Thus, the Department respectfully requests that this case be remanded to the
Department so that it may overturn Jones’ conviction and return any lost good time.
IT IS HEREBY ORDERED that the Department’s Motion for Remand be granted.
AND IT IS SO ORDERED.
