ORDER OF DISMISSAL

The above captioned case is pending before the Administrative Law Court. It now appears that pursuant to a letter dated May 3, 2005, from Lynn M. Baker, counsel for the Petitioner, that the Department seeks to dismiss the bingo violation pending against the Respondents. It has recently been brought to the attention of the Department of Revenue that the Greenville Futbol Club was incorrectly cited as the non-profit organization operating the bingo where the alleged misconduct took place. Accordingly, the Department moves to dismiss this pending violation against the Respondents.

As the Petitioner seeks to dismiss this violation as made in error, I find that there is no longer a need for a contested case hearing. As such, this violation is dismissed against the Respondents and the matter is resolved with prejudice.

AND IT IS SO ORDERED.
