ORDERS:
ORDER OF DISMISSAL
At the hearing of the above-captioned matter on April 14, 2005, counsel for Petitioner and
Intervenor agreed to a settlement of this case, which was announced on the record in open court at
that hearing.
This settlement resolves all matters in dispute in this case, and, pursuant to Rule
43(k), SCRCP, as applied under ALC Rule 68, is binding upon the parties. Therefore, as there are
no justiciable issues remaining in controversy,
IT IS HEREBY ORDERED that, pursuant to the settlement reached by the parties, the
above-captioned matter is DISMISSED with prejudice.
AND IT IS SO ORDERED.
