ORDERS:

CONSENT ORDER OF VOLUNTARY DISMISSAL

This matter came before the Administrative Law Court upon a petition of Bush River Utilities, Inc. pursuant to 25 S.C. Code Ann Regs. 61-72 and Rules of Procedure for the Administrative Law Court for an administrative review of the issuance of NPDES Permit #SC0032743 by the Respondent, the South Carolina Department of Health and Environmental Control (DHEC). Petitioner further requested that a contested case be established to review the terms of said Permit.

The Petitioner and Respondent have now mutually consented to this Order of Voluntary Dismissal based upon Respondent’s letter of clarification dated April 4, 2005, signed by Jeffrey P. deBessonet, P.E. Director of Water Facilities Permitting Division to Petitioner’s counsel, Scott Elliott, said letter attached to this Order as Exhibit 1.

IT IS THEREFORE OREDERED that, pursuant to the Rules of Procedure for the Administrative Law Court and Rule 41(a)(2), SCRCP, this matter is herby dismissed without prejudice to any of the parties.

AND IT IS SO ORDERED.
