ORDER OF DISMISSAL FOR DEFAULT

On February 25, 2005, an ORDER was issued to all parties requiring the filing of Prehearing Statements within fifteen (15) days of the date of that ORDER. Given the additional five (5) day extension allowed for mailing under ALC Rule 5(C), the Prehearing Statement was due on March 17, 2005. William Earl Porter, Jr., (Petitioner) failed to file the Prehearing Statement.

On March 22, 2005, Petitioner was again directed to file the Prehearing Statement on or before Tuesday, March 29, 2005. No Prehearing Statement was received by the close of business on the extension date of March 29, 2005, and thus Petitioner failed to comply with the Order.

Therefore, IT IS ORDERED that the hearing in the above referenced matter scheduled for Thursday, May 12, 20025, at 9:30 a.m., at the Greenville County Courthouse, Greenville, South Carolina, is canceled, and the case is hereby dismissed.

AND IT IS SO ORDERED.
