ORDER OF DISMISSAL

By letter dated January 29, 2003, Rachel Erwin, Legislative Liaison for the Department of Public Safety, informed the Administrative Law Judge Division that no comments or requests for a hearing were submitted to the Department. ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 2000) on the basis that a request for a hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. Thus, a hearing is unnecessary in this matter since no requests for a hearing were made.

IT IS THEREFORE ORDERED that the hearing scheduled in this matter is cancelled.
