ORDERS:
ORDER ON MOTION TO DISMISS
This matter came before me on Motion of the Department of Revenue to Dismiss the
Contested Case of the Petitioner due to an untimely request for a contested case hearing before
the ALC. At the hearing on the motion, held February 15, 2005, the Petitioner failed to appear.
In addition, the court has not received a prehearing statement from the Petitioner as required by
order of this court filed October 20, 2004. For these reasons, the Motion to Dismiss filed by the
Department of Revenue is GRANTED and this case is DISMISSED WITH PREJUDICE.
AND IT IS SO ORDERED.
