On March 3, 2005, James McAllister, the sole protestant of record in the above-captioned
matter, notified this tribunal that he does not intend to attend the hearing scheduled in this case
and that he wishes to withdraw his protest against the issuance of an on-premises beer and wine
permit to Petitioner. Therefore, as the sole protestant in this matter has withdrawn his protest of
Petitioner’s permit application,
IT IS HEREBY ORDERED that the hearing of the above-captioned case scheduled for
Wednesday, May 4, 2005, is CANCELED and this case is DISMISSED.
IT IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina
Department of Revenue shall CONTINUE TO PROCESS Petitioner’s application for an on-premises beer and wine permit for the premises located at 3340 Lamar Highway in Darlington,
South Carolina.
AND IT IS SO ORDERED.
