ORDER OF DISMISSAL

This matter is before the Administrative Law Court pursuant to an Agency Transmittal Form filed on February 10, 2005. Petitioner requested a contested case hearing regarding the South Carolina Department of Revenue’s (Department) administrative denial of its application for an off-premise beer and wine permit for its location at 610 S. Guignard Dr., Sumter, South Carolina due to a protest. By letter dated February 16, 2005, Wendi Bowman and Clinton Karl Ford, the only protestants in this matter, notified the Court that they wished to withdraw their protests. Therefore,

IT IS HEREBY ORDERED that this case is dismissed with prejudice.

IT IS FURTHER ORDERED that the Department resume processing the Petitioner’s application for an off-premise beer and wine permit.

AND IT IS SO ORDERED.
