Consent Order of Voluntary Dismissal

This matter came before the Administrative Law Court upon an appeal filed by the Respondents to challenge the Department’s issuance of Administrative Order 03-204-W, which principally required that the Respondents connect the Brookforest Mobile Home Estates wastewater treatment facility to the regional sewer system in accordance with the Central Midlands Areawide 208 Water Quality Management Plan. Based upon new information provided to the Department recently regarding the availability of the regional sewer system, the Department has agreed to voluntarily withdraw its Administrative Order and to have this case dismissed. The Respondents have consented to the withdrawal of the Administrative Order and to the dismissal of this case.

IT IS THEREFORE ORDERED that, pursuant to the Rules of Procedure for the Administrative Law Court and Rule 41(a)(2), SCRCP, this matter is hereby dismissed without prejudice to any of the parties.

AND IT IS SO ORDERED.
