By a letter dated February 7, 2005, Respondent South Carolina Department of Health and
Environmental Control (Department) informed this tribunal that the parties to the above-captioned matter have reached a settlement in this case. The Department also submitted
documents reflecting the settlement among the parties. Therefore, as there are no justiciable
issues remaining in controversy,
IT IS HEREBY ORDERED that the above-captioned case is DISMISSED with
prejudice.
