In the above-captioned matter, a regulatory hearing was scheduled for 10:00 a.m. on
Tuesday, February 1, 2005, at the South Carolina Administrative Law Court in Columbia, South
Carolina.
ALC Rule 45 requires an agency proposing a regulation to provide a statement, at least
ten days before the scheduled hearing date, confirming the need for a hearing on the regulation
pursuant to S.C. Code Ann. § 1-23-110 (Supp. 2004) because a request for a hearing was made
by twenty-five persons, a governmental subdivision or agency, or an association having not less
than twenty-five members. In the instant matter, the South Carolina Department of Revenue
advised this tribunal, by a letter dated January 4, 2005, that no comments or requests for a
hearing were submitted to the Department regarding the proposed regulation identified above.
Thus, pursuant to Section 1-23-110(A)(3), it is not necessary to hold a regulatory hearing in this
matter.
IT IS THEREFORE ORDERED that the hearing on the proposed regulation identified
above scheduled for February 1, 2005, at 10:00 a.m. is hereby CANCELED and this matter is
DISMISSED.
