ORDER TO DISMISS

This matter is before the Administrative Law Court (ALC or Court) pursuant to the Petitioner’s request for a contested case hearing, filed on January 16, 2009. In response to inquiries by Petitioner, the Court mailed a letter filed on February 26, 2009, that Petitioner must exhaust his administrative remedies. On March 24, 2009, Petitioner supplemented the record with a letter from the County of Lexington Assessment Appeals Board that is dated March 16, 2009, which states that the Board voted to uphold the decision of the Assessor’s office.

IT IS HEREBY ORDERED that this matter shall be DISMISSED. Petitioner may, however, appeal the decision of the County of Lexington Assessment Appeals Board within 30 days from the date of the Board’s decision without having to pay an additional filing fee. If Petitioner does not appeal the Board’s decision within the prescribed time, then this matter will be dismissed with prejudice.

AND IT IS SO ORDERED.
