SC Administrative Law Court Decisions

This matter is before the Administrative Law Court (ALC or Court) pursuant to the Request for a Contested Case Hearing filed by Petitioner on September 19, 2007. Petitioner also filed a Request for a Contested Case hearing on May 16, 2008 in a related matter, docket number 08-ALJ-07-0249-CC. Petitioner’s request for a contested case on May 16, 2008 was accompanied by a Motion to Consolidate.

On February 9, 2009, the Court held a conference call with the parties to address the status of this case and its outstanding matters. The topics of discussion were the Motion to Intervene by MRR Sandhill, the Motion to Consolidate and the scheduling of a hearing on the merits. There was unanimous agreement to allow intervention by MRR Sandhill and to allow for the consolidation of docket numbers 07-ALJ-07-0459-CC and 08-ALJ-07-0249-CC. The date agreed upon by the parties for a hearing on the merits is Wednesday, February 25, 2009 which is shown in the Notice of Hearing accompanying this Order. Therefore,

IT IS ORDERED that MRR Sandhill shall be allowed to intervene as a party respondent and shall be included in the caption for future reference as shown above.

IT IS FURTHER ORDERED that docket numbers 07-ALJ-07-0459-CC and 08-ALJ-07-0249-CC shall be CONSOLIDATED and shall be referred to for future reference by docket number 07-ALJ-07-0459-CC.
