ORDER

This matter is before the South Carolina Administrative Law Court (ALC or Court) pursuant to the request for contested case hearing filed December 5, 2008.

A hearing on the merits was scheduled to begin on Wednesday, January 28, 2009, at 2:00 p.m. at the Administrative Law Court. By telephone on January 27, 2009, Michael L. McDonald, d/b/a M.L.M. Wine & Liquors, the sole protestant in this case, notified the ALC of his desire to withdraw his protest in this matter. At 2:10 p.m. on January 28, 2009, this Court noted on the record that the Protestant failed to appear at the scheduled hearing.

Other than the timely filed public protest, the South Carolina Department of Revenue has determined that the Petitioner has met all other statutory requirements for licensure.

IT IS THEREFORE ORDERED that the South Carolina Department of Revenue continue processing Petitioner’s application for a retail liquor license for its location at 1385C Celebration Blvd., Florence, South Carolina.

AND IT IS SO ORDERED.
