ORDER OF DISMISSAL
The
Petitioner notified this Court by letter dated January 6, 2009 that it desired
to withdraw its appeal and dismiss the matter with prejudice. The letter
further informs the Court that the matter has been settled and both parties
will bear their own costs and fees,
