A hearing on the above-captioned matter was scheduled to begin at 10:00 a.m. on Monday, January 12, 2009. ALC Rule 45 requires the agency to provide a statement, at least ten days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (2007) on the basis that a request for a hearing was made by twenty-five persons, a governmental subdivision or agency, or an association having not less than twenty-five members. The South Carolina Department of Labor, Licensing and Regulation advised the court by letter dated January 5, 2009, that the Department did not receive any such requests for a hearing on the proposed regulation in the above-captioned matter and that a hearing will not be necessary. Therefore,

IT IS HEREBY ORDERED that the hearing scheduled for January 12, 2009 is cancelled.

IT IS FURTHERMORE ORDERED that this matter is DISMISSED.

AND IT IS SO ORDERED.
