ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Court (“ALC” or “Court”) pursuant to the request for contested case hearing filed October 6, 2008.

A hearing on the merits was scheduled to begin on Tuesday, December 16 at 2:00 p.m. at the Administrative Law Court. By letter filed December 3, 2008, Chuck Moss of First Baptist Church of Gaffney, the sole protestant in this case, notified the ALC of his desire to withdraw his protest in this matter. Other than the timely filed public protest, the South Carolina Department of Revenue has determined that the Petitioner has met all other statutory requirements for licensure.

IT IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED WITH PREJUDICE.

IT IS FURTHER ORDERED that the South Carolina Department of Revenue continue processing Petitioners’ application for an on-premises beer and wine permit for its location at 302 North Limestone Street, Gaffney, South Carolina.

AND IT IS SO ORDERED.
