ORDERS:
CONSENT ORDER
This matter came
before the Court pursuant to a Petition for Injunctive Relief filed by the
South Carolina Board of Auctioneers. Joseph N. Connell, Esquire represents the
Petitioner in regard to this matter and Scott N. Schreiber, Esquire, represents
the Respondent. This Court has jurisdiction over the parties and subject
matter of this action. The parties having determined that it is in their
mutual interest to settle this matter and avoid the cost, risk and expense of
further litigation; the parties having reached an agreed settlement which they
desire to be made an Order of this Court.
THEREFORE, IT
IS HEREBY AGREED AND ORDERED that the Respondent, shall not either directly
or indirectly engage in the business of Auctioneering in South Carolina unless
Respondent, by and through it properly authorized agents, is licensed pursuant
to the South Carolina Auctioneers Act, S.C. Code Ann. § 40-6-05 et seq.
Further, Respondent shall pay Two Thousand Five Hundred and 00/100 (2,500.00)
Dollars to the South Carolina Department of Labor, Finance Office, for credit
to the accounts of the Board of Auctioneers within thirty (30) days of the
execution of this Order, and upon Petitioner’s receipt of payment of such
amount this matter shall be dismissed with prejudice, with each party to bear
its own costs and expenses.

IT IS SO ORDERED.
