ORDER OF DISMISSAL

Pursuant to S.C. Code Ann. § 1-23-110(A)(3) (2005), a public hearing on an amendment to S.C. Code Ann. Regs. §§ 69-57.3 proposed by the South Carolina Department of Insurance (“Department”) was scheduled in the above-captioned matter for 10:00 a.m. on Friday, December 5, 2008, at the South Carolina Administrative Law Court in Columbia, South Carolina. ALC Rule 45 requires an agency proposing an amendment to provide a statement to the Court, at least ten days before the scheduled date of the public hearing, confirming the need for a hearing on the amendment pursuant to § 1-23-110 because a request for a hearing was made by twenty-five persons, a governmental subdivision or agency, or an association having not less than twenty-five members. Here, the Department advised this Court, by letter dated November 26, 2008, that no requests for a hearing were submitted to it regarding the proposed amendment identified above. Thus, pursuant to § 1-23-110(A)(3), it is not necessary to hold a public hearing on the proposed amendments in this matter.

IT IS HEREBY ORDERED that the hearing on the proposed amendments identified above and scheduled for 10:00 a.m. on Friday, December 5, 2008, is hereby CANCELED.

IT IS FURTHER ORDERED that this matter is DISMISSED.

AND IT IS SO ORDERED.
