ORDERS:
CONSENT ORDER CANCELING PERMIT AND DISMISSING CASE
This case involves a
permit used by the South Carolina Department of Health and Environmental
Control, Office of Ocean and Coastal Resource Management, to Wild Dunes
Community Association, Inc., for the scraping, hauling and re-placement of sand
on the beach at the Isle of Palms.
By Consent Order filed
April 30, 2008, this case was stayed based upon the parties’ agreement that
upon initial implementation of another permit not at issue in this case
(DHEC/OCRM Permit No. 2007-02631-21G-P, issued to the City of Isle of Palms),
the parties would cancel the permit at issue in this case (Permit No. 00-715-E)
and dismiss this case.
The parties now
acknowledge that the implementation of Permit No. 2007-02631-21G-P has taken
place.
Now therefore, upon the
joint motion and consent of the parties hereto,
IT IS HEREBY ORDERED
(1) that Permit No. 00-715-E is canceled and shall have no further force or
effect, and (2) that this contested case proceeding be, and same hereby is,
DISMISSED, with prejudice.
AND IT IS SO ORDERED.
