ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law
Court. The Petitioner requested a contested case hearing following the
Department of Revenue’s denial of the Petitioner’s request for retail liquor
license based on the receipt of valid public protest as to suitability of the
location by Captain Joseph R. Shampine. According to the Department, the SLED
investigation also revealed that the proposed location had access between the
location for the liquor store and the convenience store in the same building. Captain
Joseph R. Shampine notified the Court by letter dated October 27, 2008 that he
wished to withdraw his protest. By letter dated November 3, 2008, the
Petitioner stipulated that location will pass a final inspection by SLED and
the Department stated that once notice has been received that renovations are
complete, a final inspection will be requested. Pending a final inspection
that is in compliance with all statutory requirements it is hereby:
ORDERED that this matter is remanded to the Department of Revenue to continue to
process the Petitioner’s application granting the retail liquor license to the
Petitioner for the location at El Cheapo Liquor II, 1630 B Longcreek Drive in Columbia,
South Carolina and this case is therefore dismissed.
AND
IT IS SO ORDERED.
