ORDER OF DISMISSAL

This matter is before the Administrative Law Court (“ALC” or “Court”) pursuant to a request for a contested case hearing regarding the denial of Petitioner’s application for a beer and wine permit and liquor by the drink license. Pursuant to notice to the parties, a hearing on this matter was held on Thursday, October 9, 2008, at the offices of the Administrative Law Court in Columbia, South Carolina. At the commencement of the hearing, the South Carolina Department of Revenue (“Department”) made a motion to dismiss based upon the recent dissolution of Lancaster Tavern, LLC. The Department asserted that because the applicant no longer existed, there was no longer a valid application for a beer and wine permit and liquor by the drink license. Counsel for Petitioner consented to this motion and withdrew its application. Accordingly,

IT IS HEREBY ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
