ORDERS:
ORDER OF DISMISSAL
This matter is before
me on the appeal of the Jonathan B. May (Appellant). Administrative Law Court
Rule 35 states:
The
party first filing the notice of appeal shall be responsible for ordering a transcript
and shall file a copy of the request for a transcript with the notice of appeal.
Unless otherwise agreed by all parties in writing, the appellant must order the
entire transcript. The administrative law judge may also order the agency to prepare
a transcript. The transcript of the proceedings shall be filed with the clerk of
the Court by the agency pursuant to Rule 36.
The
Department filed a Motion to Dismiss on September 8, 2008. As of the date of
this Order, Appellant has not responded to the Department’s Motion. As the
Appellant has been afforded ample time to request a transcript and has not
notified the ALC of any extenuating circumstances regarding his failure to do
so, I conclude that this matter should be dismissed sua sponte.
IT IS THERFORE ORDERED that this case be DISMISSED.
AND IT IS SO ORDERED.
