ORDERS:
ORDER OF DISMISSAL WITHOUT PREJUDICE
It
was previously ordered that the contested case hearing in this matter be heard
on the merits before the undersigned Administrative Law Judge on August 12,
2008. The court was notified by email dated August 8, 2008 that the parties
requested a stay in this matter due to the fact that the Respondent filed
Bankruptcy with the United States Bankruptcy Court in the District of South
Carolina. The Bankruptcy Court imposed an automatic stay in all actions
involving this Corporation pursuant to a 341 Notice which was issued on July
25, 2008. However, this action will not remain on the docket of this Court while
this matter during the pendency of the bankruptcy action.
THEREFORE,
IT IS HEREBY ORDERED this matter is DISMISSED WITHOUT PREJUDICE.
AND
IT IS FURTHER ORDERED that the Petitioner be allowed to re-file this action
after the Bankruptcy action is complete without having to pay additional filing
fees to this Court.
AND
IT IS SO ORDERED.
