ORDERS:
ORDER OF CONSOLIDATION
The above captioned
matters are currently pending before the South Carolina Administrative Law
Court ("ALC").
On August 14, 2008, Petitioner Palm
Food Stores filed a Motion to Consolidate the three (3) contested case matters
with the ALC. It appears that the Respondent has consented to the Motion to
Consolidate.
The Petitioner states
in its motion that the three outstanding matters involve similar facts and
having separate hearings will cause an undue burden and unnecessary duplication
of efforts for the Court and the parties involved in the matter. Therefore, in
the interest of judicial economy, it is hereby ORDERED that these
matters are consolidated into one contested case.
IT IS FURTHERED
ORDERED that the caption in this matter will read Palm Food Stores, LLC,
d/b/a Li’L Cricket 832, 885, and 888 vs. South Carolina Department of Revenue, and shall bear Docket No. 08-ALJ-17-0343-CC.
These cases are consolidated for
all purposes, including discovery and hearing.
AND IT IS SO ORDERED.
