ORDER OF DISMISSAL

This matter is before the Administrative Law Court (“Court”) pursuant to Petitioner’s application for an on-premises beer and wine permit and liquor by the drink license. The application was protested by Mr. John F. Franklin. After notice to the parties, a hearing was scheduled for Thursday, August 21, 2008. The Notice of Hearing was timely mailed to the Protestant. The Protestant did not appear at the hearing. Absent any appearance or testimony from the Protestant, the protest is deemed abandoned. The Department would have issued the permit but for the concerns of the citizen as to suitability of the location.

IT IS HEREBY ORDERED that the above-captioned matter is forwarded to the Department of Revenue to continue to process the application of Upstate Dining Concepts, LLC, 317 Haywood Road, Greenville SC, and to issue the requested permit.

IT IS FURTHER ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
