ORDERS:
CONSENT ORDER OF DISMISSAL
The
undersigned attorneys for Berry-Boger Yacht Sales, Inc., (“Taxpayer”) and the
South Carolina Department of Revenue (“Department”) represent that they have
resolved the issues in this matter, and, therefore, consent to a dismissal in
the above-referenced matter. The parties in this case have reached a
settlement on all contested issues and jointly stipulate to and request
dismissal of the case with prejudice.
The
Taxpayer has agreed to pay sales taxes on all vessels sold or brokered by it,
including US Coast Guard Documented vessels, in compliance with South Carolina
law. In addition, the Taxpayer shall pay all sums due to the Department as
agreed upon by the parties within forty-five (45) days of the date of this
Order.
AND
IT IS SO ORDERED.
