ORDERS:
FINAL ORDER AND DECISION
This
matter comes before this court pursuant to S.C. Code Ann. § 61-2-260 (Supp. 2007),
S.C. Code Ann. § 1-23-600(B) (Supp. 2007), and S.C. Code Ann. §§ 1-23-310 et
seq. (2005 & Supp. 2007) for a contested case hearing. Petitioner Robert
H. Cary, Jr. seeks an on-premises beer and wine permit for RRR of Greenwood,
LLC, d/b/a Cary’s, located at 1215 Highway 72 Bypass in Greenwood, South
Carolina. Respondent denied Petitioner’s application for the permit because of
a protest filed by Samuel B. Stevenson, Jr., a Greenville County resident,
regarding the applicant’s character to hold such a permit. By letter filed on
April 18, 2008, Mr. Stevenson advised this court that he was withdrawing his
protest.
Therefore, IT IS HEREBY ORDERED that the above captioned matter is dismissed. The
Department shall GRANT Petitioner’s application for an on-premises beer
and wine permit for the premises located at 1214 Highway 72 Bypass in Greenwood,
South Carolina, and continue processing Petitioner’s application immediately. AND
IT IS SO ORDERED.
