ORDER OF DISMISSAL

The above-captioned contested case was filed with the Administrative Law Court (Court) on September 22, 2004, in which the Petitioner is contesting the Department of Revenue’s (Department) denial of an off-premise beer and wine permit. On November 30, 2004, Charles Reeves, the sole Protestant, filed a letter with the Court in which he set forth that he was withdrawing his protest in this matter. Therefore,

IT IS HEREBY ORDERED that this matter is dismissed with prejudice.

IT IS FURTHER ORDERED that the Department resume processing the Petitioner’s application for an off-premise beer and wine permit.

AND IT IS SO ORDERED.
