ORDERS:
ORDER OF DISMISSAL WITH LEAVE TO RESTORE
This
matter is before the Administrative Law Court (“Court”) pursuant to a request
for a contested case hearing filed by Petitioner on March 10, 2006 regarding
the decision of the Tourism Expenditure Review Committee.
On
April 28, 2008, counsel for both parties submitted a Consent Order of Dismissal
With Leave to Restore to the Court and requested that this matter be dismissed
with leave to restore in one (1) year’s time. Accordingly, the Consent Order
is incorporated herein by reference, and
IT IS HEREBY ORDERED that the above-captioned case is dismissed with leave to restore. The City
shall have one (1) year from the date of this order within which to file notice
that the instant case is restored. Upon filing of such notice, a new docket
number will be assigned to the instant case.
AND IT IS SO
