DISMISSAL

A
hearing on the above-captioned matter was scheduled to begin at 9:00 a.m. on Monday,
April 21, 2008. ALC Rule 45 requires the agency to provide a statement, at
least ten days before the scheduled hearing date, confirming the need for a
hearing pursuant to S.C. Code Ann. § 1-23-110 (2005) on the basis that a
request for a hearing was made by twenty-five persons, a governmental
subdivision or agency, or an association having not less than twenty-five
members. The South Carolina Department of Labor, Licensing and Regulation (“Department”)
advised the court by letter dated April 18, 2008, that the Department did not
receive any such requests for a hearing on the regulation in the
above-captioned matter and that a hearing will not be necessary. Therefore, it
is
ORDERED that the hearing scheduled for April 21, 2008 is canceled. It is further
ORDERED that this matter is DISMISSED.
