The South Carolina Department of Revenue (Department) initiated this matter by issuing a Notice of Intent to Revoke to Buck Truett, d/b/a Triple Crown Sports Bar & Grill, (Respondent) on September 13, 2007, for a violation of S.C. Code Ann. § 61-4-580(3) (Supp. 2007) for permitting games of chance on or about August 30, 2007. Respondent holds permit and license number 32026195-PBW/PLB, authorizing the sale of beer and wine and liquor by the drink for on-premises consumption at the location, 103 12th Street, West Columbia, South Carolina.

The parties, as attested to by their undersigned signatures, have indicated that the matter has been resolved upon the following terms and conditions:

1. Respondent agrees to turn over its permit and license and suspend all sales of beer, wine, and alcohol on the licensed premises for 5 days, to begin at 10:00 p.m. on Tuesday, March 12, 2008, and end at 9:59 p.m. on Monday, March 17, 2008.

2. Respondent agrees to pay a $2,000 fine to the Department on or before March 27, 2008 PO Box 12265, Columbia, SC, 29211, Attn: Andrew Richardson, Jr.

3. The parties further agree to enter into a Consent Agreement which would prohibit the Respondent from keeping or permitting any illegal gaming devices, gambling, or games of chance upon the licensed premises. In the event the Respondent violates said Consent Agreement within three years of February 27, 2008, the Respondent understands and agrees that such violation will result in revocation of his beer and wine permit and liquor by the drink license issued by the Department.

The parties further agree that they freely and voluntarily entered into this Agreement and such constitutes the full and final resolution of this matter and such is RESOLVED

WITH PREJUDICE.

IT IS SO ORDERED.
