ORDERS:
ORDER
This matter is before
the Administrative Law Court pursuant to the request of John L. Adams for a
contested case hearing. Adams, whose driver’s license was suspended by
Respondent pursuant to S.C. Code Ann. § 56-5-2990 (2006), alleges that
Respondent erroneously denied his application for a route-restricted driver’s license.
S.C. Code Ann. § 56-1-10(23) (Supp. 2007) expressly states that “[t]he Division
of Motor Vehicle Hearings conducts all hearings or administrative hearings arising
from department actions.” Therefore,
IT IS HEREBY ORDERED that this matter is DISMISSED; and
IT IS FURTHER ORDERED that, due to the novelty of the jurisdiction issue presented here, Adams shall have fifteen (15) days from the date of this Order to file a request for a
contested case hearing with the Division of Motor Vehicle Hearings.
AND IT IS SO ORDERED.
