ORDERS:
ORDER OF DISMISSAL (Regulation)
A
hearing on the above-captioned matter was scheduled to begin at 10:00 a.m. on Monday,
April 14, 2008. ALC Rule 45 requires the agency to provide a statement, at
least ten days before the scheduled hearing date, confirming the need for a
hearing pursuant to S.C. Code Ann. § 1-23-110 (2005) on the basis that a
request for a hearing was made by twenty-five persons, a governmental
subdivision or agency, or an association having not less than twenty-five
members. The South Carolina Department of Public Safety (“Department”) advised
the court by letter dated April 3, 2008, that the Department did not receive
any such requests for a hearing on the regulation in the above-captioned matter
and that a hearing will not be necessary. Therefore, it is
ORDERED that the hearing scheduled for April 14, 2008 is canceled. It is further
ORDERED that this matter is DISMISSED.
