ORDERS:
ORDER OF DISMISSAL
THIS MATTER COMES before me at the request of the
Petitioner, South Carolina Board of Medical Examiners, which, with the consent
of the Respondent, Newberry County Memorial Hospital and Anonymous Physician
moves for a voluntary dismissal of the above-captioned contested case. By a
Consent Order which was filed on November 6, 2007, the Court was notified that
the Parties agreed to pursue alternatives other than
this litigation in order to resolve the issues presented by this case.
Based on good cause shown,
IT IS THEREFORE ORDERED, ADJUDGED AND
DECREED that, pursuant
to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, with the
consent of all parties hereto, this action, including all claims herein
asserted by all parties, is hereby dismissed without prejudice.
AND IT SO ORDERED.
