ORDERS:
FINAL ORDER AND DECISION
This
matter comes before this Court pursuant to S.C. Code Ann. § 61-2-260 (Supp. 2007),
S.C. Code Ann. § 1-23-600(B) (Supp. 2007), and S.C. Code Ann. §§ 1-23-310 et
seq. (2006) for a contested case hearing. Petitioner Shanita Peppers seeks
an on-premises beer and wine permit for Main Event Sports Barber Shop, located
at 3214-A Augusta Road in Greenville, South Carolina. Respondent denied
Petitioner’s application for the permit because Petitioner had failed to file a
sales tax return for one month and because of a protest filed by R.H.
Patterson, Sr., a Greenville County resident, regarding the proposed location’s
suitability for Petitioner’s sports barbershop.
By
fax dated February 18, 2008, Mr. Patterson advised this court that he would be
unable to attend the hearing scheduled today. By failing to attend, he is
deemed to have waived his protest of the application. By letter dated February
19, 2008, the Department advised this court that the sales tax return issue had
been resolved and that the sole reason for holding the hearing was Mr.
Patterson’s protest.
Therefore, IT IS HEREBY ORDERED that the above captioned matter is dismissed. The
Department shall GRANT Petitioner’s application for an on-premises beer
and wine permit for the premises located at 3214-A Augusta Road in Greenville,
South Carolina, and continue processing Petitioner’s application immediately. AND
IT IS SO ORDERED.
