ORDERS:
ORDER OF DISMISSAL
This
matter is before the Administrative Law Court (“ALC” or “Court”) pursuant to a
request for a contested case hearing regarding the South Carolina Department of
Revenue’s (“Department”) denial of Petitioner’s application for an on-premises
beer and wine permit (“permit”) and restaurant liquor by the drink license
(“license”). The Department based its denial of Petitioner’s application on
timely filed public protests and Petitioner’s alleged failure to file sales tax
returns for the months of June and July 2007.
The
Protestants in this matter, David E. Griffith and R.H. Patterson, Sr., notified
the Court by letters dated December 27, 2007 and December 28, 2007,
respectively, that they were unable to attend the hearing and therefore
withdrew their protests. Furthermore, at the commencement of the hearing, the
parties notified the Court that the issue regarding the filing of sales tax
returns had been resolved. There being no remaining issues regarding the
issuance of the permit and license before the Court,

IS HEREBY ORDERED that the Department resume the processing of Petitioner’s
application for an on-premises beer and wine permit and restaurant liquor by
the drink license; and
IT
IS FURTHER ORDERED that this matter is dismissed with prejudice.
AND
IT IS SO ORDERED.
