ORDERS:
ORDER OF DISMISSAL
Pursuant
to S.C. Code Ann. § 1-23-110(A)(3) (2005), a public hearing on the promulgation
of Regulation 69-66 as proposed by the South Carolina Department of Insurance
was scheduled in the above-captioned matter for 10:00 a.m. on Wednesday, December
5, 2007, at the South Carolina Administrative Law Court in Columbia, South
Carolina. This matter must now be dismissed.
ALC
Rule 45 requires an agency proposing a regulation to provide a statement to the
Court, at least ten days before the scheduled date of the public hearing,
confirming the need for a hearing on the regulation pursuant to S.C. Code Ann.
§ 1-23-110 (2005) because a request for a hearing was made by twenty-five
persons, a governmental subdivision or agency, or an association having not
less than twenty-five members. In the instant matter, the South Carolina
Department of Insurance advised this Court, by a letter dated November 29, 2007,
that, although a hearing was initially requested by the Property Casualty
Insurers Association of America (PCI) on behalf of its member insurance
companies, the parties have resolved their concerns and no other requests for a
hearing were submitted to the Department regarding the proposed regulation
identified above. Thus, pursuant to Section 1-23-110(A)(3), it is not
necessary to hold a public hearing on the proposed regulation in this matter.
IT
IS THEREFORE ORDERED that the hearing on the proposed regulation identified
above scheduled for Wednesday, December 5, 2007, is hereby CANCELED and
this matter is DISMISSED.
AND
IT IS SO ORDERED.
