ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before me upon
Motion by Respondents and with Petitioner’s consent for entry of a Consent
Order of Dismissal. This is a contested case wherein Respondents challenge an
Administrative Enforcement Order issued by Petitioner. Petitioner seeks
removal of a houseboat moored at property owned by Respondents, located on
Inlet Creek, Charleston County, S. C. Petitioner further seeks payment of a
fine in the amount of $1,000.00.
Following issuance of the
Administrative Enforcement Order and the filing of the Request for a Contested
Case, Respondents complied with the Order and moved the houseboat out of
tidelands critical area and onto upland property. Based on Respondents’
compliance, the Petitioner has agreed to reduce the fine to $500.00, and
Respondents have agreed to pay a fine of $500.00.
Therefore, upon motion by
Petitioner and with Respondent’s consent, as is evidenced by their signatures
below, and based on the terms of the settlement as set forth above, this
contested case is, hereby, DISMISSED.
AND IT IS SO ORDERED.
