ORDERS:
CONSENT ORDER
This
matter is before me by consent of the parties for entry of a Consent Order.
The Petitioner, Brenda Gall, applied with the Respondent South Carolina
Department of Health and Environmental Control (the “Department”) to amend
Permit Number OCRM-06-069M to allow placement of a 12’ x 12’ hip-style roof
over her previously approved 10’ x 10’ fixed pierhead. The Department denied
Petitioner’s permit amendment request. Petitioner timely requested a contested
case hearing before this Court, challenging denial of the permit amendment.
The parties have resolved their differences and have agreed to allow placement
of a 12’ x 12’ roof over the fixed pierhead as long as no other additional
modifications are requested by the Petitioner barring a change in circumstances
or emergency situation. This agreement shall be binding on the parties and
their heirs and assigns, however, not subsequent property owners.
Therefore it is
ordered that Permit Number OCRM-06-069M is hereby amended in accordance with
the terms set forth above.
AND IT IS SO ORDERED.
