ORDERS:
ORDER OF DISMISSAL WITHOUT PREJUDICE
This matter is before the Administrative Law Court
pursuant to a Petitioner’s request for a
contested case hearing, whereby he contests the issuance of a dock permit by Respondent South
Carolina Department of Health and Environmental Control, Office of Coastal Resource Management
(SCDHEC - OCRM) to Respondent Donald Walters.
By Order dated April 12, 2004, the Court stayed this action pending the resolution of
litigation in the Court of Common Pleas for Charleston County. The matter was also stricken from
the active docket with leave for either party to move for reinstatement upon resolution of the matter
pending in circuit court. The Court further ordered that if neither party moved for reinstatement
within six months of the April 12, 2004 Order, that the case would be dismissed without prejudice
at that time.
Because neither party has moved for reinstatement of the matter within the last six months,
IT IS HEREBY ORDERED this matter is dismissed without prejudice.
AND IT IS SO ORDERED.
