ORDERS:
ORDER OF DISMISSAL
THIS
MATTER COMES before me at the request of the Petitioner, South Carolina
Department of Revenue which, with the consent of the Respondent, James A.
Newman d/b/a BI Fast 1, moves for a voluntary dismissal of the above-captioned
contested case. By Consent Order, which was signed by Petitioner’s counsel on
September 6, 2007 and Respondent’s counsel on September 12, 2007, the Court was
notified that the Parties had settled this matter, and that the Respondent has
paid the monetary penalty in full. Based on good cause shown,
IT
IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2)
of the South Carolina Rules of Civil Procedure, with the consent of all parties
hereto, this action, including all claims herein asserted by all parties, is
hereby dismissed. That previous Order of the Court filed July 31, 2007 requesting Prehearing Statements, is vacated.
AND
IT IS SO ORDERED.
