ORDERS:
ORDER OF DISMISSAL
This
matter is before the South Carolina Administrative Law Court (“ALC” or “Court”)
for a contested case hearing upon the request of Petitioner filed September 17,
2007.
A
hearing on the merits was scheduled to begin on Tuesday, November 6 at 10:00
a.m. at the Administrative Law Court. On October 3, 2007, the Lexington Country
Sheriff’s Department and Wayne and Wanda King, the sole protestants in this
case, notified the Court of their desire to withdraw their protests in this
matter.
IT
IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED
WITH PREJUDICE.
IT
IS FURTHER ORDERED that the South Carolina Department of Revenue continue
processing Petitioner’s application for an on-premises beer and wine permit and
non-profit private club liquor by the drink license for its location at 911
Hwy. 178, Pelion, South Carolina.
AND
IT IS SO ORDERED.
