ORDERS:
ORDER OF DISMISSAL
THIS MATTER COMES before me at the request of the Petitioner, James G. Nance which requested a contested case hearing on the basis that the Respondent failed to respond to a claim for a tax refund of certain property taxes paid by the Petitioner.
On September 2, 2004, the Respondent informed the Court that it was in the process of resolving the matter. Three years later on March 7, 2007, the Court contacted the Respondent and the attorney for the Petitioner for a status update on the case. To this date, nothing was ever received by the Court. Based on good cause shown,
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(b) of the South Carolina Rules of Civil Procedure, this action, including all claims herein asserted by all parties, is hereby dismissed.
AND IT IS SO ORDERED.
