ORDER OF DISMISSAL
In the above-captioned matter, Petitioner Rita R. Brown challenges the decision of Respondent South Carolina Department of Health and Environmental Control to issue permit number OCRM-06-0991 on May 17, 2007, to Bill Jones, for the construction of a private dock at 50 Johnny Morrall Circle in Beaufort County, South Carolina. However, after the issuance of that permit, Mr. Jones transferred the dock permit for the property located at 50 Johnny Morrall Circle to Beaufort River Development, LLC. By Stipulation of Dismissal of Appeal filed on October 8, 2007, counsel for petitioner indicated she dismisses this matter by voluntary nonsuit pursuant to Rule 41(a)(1), SCRCP and ALC Rule 68. On October 9, 2007, Respondents filed their consent to the dismissal. Therefore, IT IS HEREBY ORDERED that the above-captioned case is DISMISSED.
AND IT IS SO ORDERED.
